A contract or listing agreement, and ultimately the Deed, must be signed by someone who has the legal right to do so (such as a trustee, manager, personal representative, or agent acting under a power of attorney), as well as by all the appropriate parties (such as the spouse, co-trustee, beneficiaries, etc.). These documents are the most critical aspects of any real estate transaction and can determine whether a transaction can even legally occur. While the concept of contracts and agreements seems simple enough, they can get complicated when the property in question is owned by multiple people, by a corporation or by a trust. This class will discuss how to determine who really owns a piece of property, how to make sure you have all the rightful owners, and how to prevent common mistakes and pitfalls.
